These Terms and Conditions apply to purchases made through orbist.co.uk. Please read them before placing an order. They explain who we are, how a contract is formed, and your rights and responsibilities. Nothing in these terms limits any rights you have under applicable consumer law.
1. About us
This website is operated by Orbist Ltd, a company registered in England and Wales under company number 13256091. Our registered office is 284 Chase Road, A Block, 2nd Floor, London, England, N14 6HF. You can contact us at support@orbist.co.uk.
2. Who may place an order
You must be at least 18 years old and legally capable of entering into a contract to place an order. You are responsible for ensuring that the information you provide, including your billing and delivery details, is complete and accurate.
3. Products and descriptions
We take reasonable care to display product descriptions, colours, measurements and images accurately. Colours and appearance may vary slightly depending on your device or screen. Packaging may also differ from that shown. Product availability is subject to change.
Please use the product information and our Size Guide when selecting a size. If you need assistance before ordering, contact us.
4. Orders and formation of the contract
After you submit an order, we will send an acknowledgement confirming that we have received it. This acknowledgement is not acceptance of your order. A binding contract is formed only when we send you a dispatch confirmation.
We may decline or cancel an order before dispatch where, for example, a product is unavailable, payment cannot be authorised, we identify an error in the price or description, we suspect fraud or misuse, or we cannot deliver to the address provided. If we cancel an order after taking payment, we will refund the amount paid to the original payment method.
5. Prices, delivery charges and payment
Prices are shown in pounds sterling and include VAT where applicable. Delivery charges, if any, are shown before you place your order. The total amount payable will be displayed at checkout.
We take reasonable care to ensure that prices are correct. If an obvious pricing error is discovered, we may contact you for instructions or cancel the affected order and refund any payment made. Payment must be made using one of the payment methods offered at checkout. Your payment provider may carry out additional security or authorisation checks.
6. Promotions and discount codes
Promotions and discount codes are subject to any specific terms displayed with the offer. Unless stated otherwise, they cannot be exchanged for cash, applied retrospectively, or combined with another offer. We may refuse or withdraw a promotion where it has expired, has been used contrary to its terms, or has been affected by an obvious technical or pricing error. This does not affect orders already accepted unless fraud or misuse is involved.
7. Delivery
We currently offer delivery options within the United Kingdom. Available services, charges and estimated delivery times are described on our Shipping page and at checkout. Delivery estimates are not guaranteed unless we expressly agree a fixed date.
We will deliver without undue delay and, unless a different period is agreed with you, within 30 days after the contract is formed. If delivery is delayed by an event outside our reasonable control, we will contact you as soon as reasonably possible and take steps to minimise the delay.
You are responsible for providing a complete and accurate delivery address. Risk in the products passes to you when they are delivered to you or to a person identified by you to receive them. Ownership passes when we have received payment in full.
8. Cancelling an order before dispatch
If you wish to cancel an order before it is dispatched, contact support@orbist.co.uk as soon as possible and include your order number. We cannot guarantee that a cancellation request will be processed before dispatch. If the order has already been dispatched, you may use your statutory cancellation rights and our returns process.
9. Your right to cancel an online purchase
For most products bought online, you have a statutory right to cancel the contract without giving a reason. The cancellation period ends 14 days after the day on which you, or a person nominated by you other than the carrier, receives the goods. If one order is delivered in separate consignments, the period ends 14 days after the final item is received.
To exercise this right, you must tell us clearly that you wish to cancel before the cancellation period expires. You may email support@orbist.co.uk, use our return request process, or use the model cancellation form shown on our Returns page.
After notifying us, you must return the goods without undue delay and no later than 14 days after telling us that you wish to cancel. We currently provide a free UK Evri return label in accordance with our Returns page. If you choose another return method without our prior agreement, you will normally be responsible for that cost. Our voluntary 90-day returns policy offers additional time for eligible items and does not replace or limit your statutory rights.
10. Condition of returned goods and refunds
You may handle and inspect the goods in the same way that you would in a shop. We may make an appropriate deduction from the refund if the value of the goods has been reduced by handling beyond what is necessary to establish their nature, characteristics and fit.
Where the statutory right to cancel applies, we will refund the price paid and the cost of our least expensive standard delivery option. Any additional amount paid for an enhanced or express service is not normally refundable. We will use the same payment method used for the original purchase unless you expressly agree otherwise, and we will not charge a refund fee.
We may withhold the refund until we receive the goods or you provide evidence that you returned them, whichever occurs first. We will then issue the refund within 14 days. Your bank or payment provider may take additional time to credit your account. More information is available on our Returns page.
11. Faulty, damaged or incorrectly supplied products
We are under a legal duty to supply goods that are as described, of satisfactory quality and fit for purpose. If a product is faulty, damaged on arrival, misdescribed or incorrectly supplied, contact us promptly with your order number and, where helpful, photographs.
Under the Consumer Rights Act 2015, you will normally have a short-term right to reject goods that do not conform to the contract within 30 days. After that period, you may normally be entitled to a repair or replacement and, in the circumstances set out by law, a price reduction or final right to reject. We will bear the reasonable cost of returning goods that are validly rejected because they do not conform to the contract. The remedy available depends on the circumstances and the applicable law.
These rights apply independently of our voluntary warranty. Our Warranty page provides additional information but does not limit your statutory rights.
12. Exchanges
We do not currently process direct exchanges. If you need a different size or product, place a new order and return the original item in accordance with our Returns page. This does not affect your statutory rights.
13. Our responsibility to you
We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or breach of your statutory consumer rights.
We supply products for domestic and private use. If you use a product for a commercial, business or resale purpose, we are not responsible for business losses such as loss of profit, revenue, contracts, anticipated savings, data or business opportunity. We remain responsible for loss or damage that is a foreseeable result of our breach of contract or failure to use reasonable care and skill.
14. Events outside our control
We are not responsible for delay or failure caused by circumstances outside our reasonable control. We will contact you where practicable, take reasonable steps to reduce the effect of the event, and resume performance as soon as reasonably possible. Your statutory rights, including rights relating to seriously delayed delivery, remain unaffected.
15. Website use and intellectual property
The website and its text, graphics, photographs, logos and other content are owned by or licensed to Orbist Ltd and are protected by intellectual-property laws. You may use the website for personal, non-commercial shopping and information purposes. You must not copy, reproduce, modify, distribute, scrape, reverse engineer or commercially exploit the website or its content except where permitted by law or with our prior written permission.
Links to third-party websites are provided for convenience. We do not control those websites and are not responsible for their content or privacy practices.
16. Personal information
We process personal information in accordance with our Privacy Policy. Our cookie controls allow you to manage non-essential data collection preferences.
17. Changes to these terms
We may update these terms to reflect changes to our business, services or legal obligations. The terms in force when your order is accepted will apply to that order. We will publish updated terms on this page and change the “Last updated” date.
18. Governing law and disputes
These terms are governed by the laws of England and Wales. The courts of England and Wales will have jurisdiction, but if you live in Scotland or Northern Ireland you may also bring proceedings in the courts of the part of the United Kingdom where you live. Any mandatory consumer protections that apply where you live are not affected.
